The DIATC Metropolitan District (the “District”) is a Title 32 Special District that has been established for the purpose of financing and installing street, park and recreation, water, sanitation, transportation, mosquito control, safety protection, fire protection, and television relay and translation improvements of the District; the provision of covenant enforcement, design review, and security services; and all other improvements or services permitted by Article 1, Title 32, C.R.S. (collectively, the “Public Improvements and Services”), except as specifically limited by the Service Plan for the District approved by the City Council of the City of Commerce City, Colorado on December 19, 2011, as it may be amended from time to time (the “Service Plan”)
The Public Improvements and Services are for the use and benefit of the users and taxpayers of the District. The District is located in the City of Commerce City, Colorado. The District is a quasi-municipal political subdivision of the State of Colorado authorized to provide specialized services that the City of Commerce City does not provide.
The District may incur a maximum debt of $40,500,000.00. The District may use any and all legally available revenues of the District, including ad valorem property taxes and specific ownership taxes, to repay such debt.
The District may assess a maximum mill levy of fifty (50) mills (subject to adjustment for changes in the method of calculating assessed valuation or any constitutionally or statutorily mandated tax credit, cut, or abatement on or after January 1, 2011) to repay such debt.
The District must file an Annual Report with the City of Commerce City Director of Community Development, the Division of Local Government, the State Auditor, and the Adams County Clerk and Recorder.
The District boundaries overlap with the boundaries of: Adams County, Rangeview Library District, City of Commerce City, South Adams County Fire Protection District, South Adams County Water and Sanitation District, Urban Drainage and Flood Control District, Urban Drainage and Flood Control District South Platte, and E-470 Commercial Area General Improvement District.
